Legal Question in Family Law in Arizona

Mother wants to move out of state

We were together for 6 years, unmarried. We have 2 children, they both have my last name and my name on their birth certificates. We have not gone to court at all over custody and decided to go 50/50 I have them Thurs-Sun, she has them sun night-thurs morning. We both accept whole heartedly that i am the father. She wants to take my 2 new sons and move to Oregon from AZ where both of our families are. It is not for a relationship nor a better job. She has no degree nor is she in college. What can i do to stop her from taking my children out of state and so far away?

Re: Mother wants to move out of state

Did you put your 5050 arrangement on paper? Is it a court order? If so, she won't be allowed to move without court order. If not, technically there is nothing to stop her and you need to immediately seek a court order barring her from doing so atleast and until the court has a hearing on the issue. If you have been practicing an equal time share arrangement and without a great reason to relocate, she won't likely be able to move. I recently had published an article about relocation if you would like a copy.
