Motion for chage of Judge / Commissioner

I have a case that has been reassigned to a commissioner because the old commissioner became a judge and reassigned the case to a newly appointed commissioner. The problem is the new commissioner is/was the attorney for my ex-wife and we have already been to some hearings with him acting as the attorney. This seems to conflict with A.R.S 12-409 subsection (B) but he isn't a judge but a commissioner. Can I file a motion for a change of judge and what are my timelines to do so?
