motorcycle dented

Son has been sent certified letter by his Uncle for Small Claims Court suing for 1500.00 over a dented fender on a 10 year old Harley Davidson. No police report or insurance filed. My son was encouraged by his Uncle to take his motorcycle for a ride. My son lost control and hit a parked car. There was no damage to the parked car. 6 witnesses heard my brother encourage my son to ride his motorcycle. This happened 1 1/2 years ago. My son is away at Army basic training and not scheduled to return until February and then he will be sent to Iraq. He was sent a certified letter and his girlfriend signed for it. What are his options?

Send a notice to the Court of your son's service and cite: Soldiers and Sailors Civil Relief Act, which provides that a service member who is either the plaintiff or the defendant in a civil lawsuit may request a stay, postponement, of a court proceeding in which he/she is a party. A service member may request a stay at any point in the proceedings.
