Legal Question in Family Law in Arizona

non-compliance of divorce settlement

When my daughter-in-law divorced my son, she agreed in the divorce decree to pay us $2000 in return for a truck in her name that we paid off. We gave her the truck and she has not kept her agreement to pay us $100 per month. What is our recourse? We live in Arizona raising her kids and she lives in Albuquerque, NM.

Re: non-compliance of divorce settlement

You are her creditor and as such have rights to sue her for breach of contract. Unless you have something in writing giving you a secured interest in the truck (lien), then generally you will not be able to repo.
