Obtaining Custody of Nephew

I would like to find out how to obtain custody of my 3 year old nephew. His father (my brother) is in prison. His mother has been kicked out of 7 homes and fired from 5 jobs in the past year. She is leaving him with ''friends'' for weeks at a time. When she does have him she just drags him all over the place and parties. When he is with her he spends 80% of his life in a car. He is sick all the time and has been in the hospital 3 times over the past year. My brother said he will sign over custody to me, but he ex won't even let me see my nephew. I have a stable home, I've been married for 10 years and have to kids. I have a good job and a nice home. On the rare occasions that I get to speak to my nephew he always cries and asks me if he can come to my house. He is in Arizona and I am in California. What can I do? Do I stand a chance?

You might first talk to the mother. If that is not possible, you should probably call CPS. Otherwise, to petitioner through the legal process will be very expensive and your chance of winning is not real good. Good Luck, Pat McCrary
