Legal Question in Family Law in Arizona

one parent moving

My husband has joint custody of his 12yr old daughter with his ex-wife. She has moved 140 miles away from us. We don't know what to do. She left the girl here with us on our weeks and her grandparents on her weeks. We want to get custody but do not want to put a huge retainer down until we have to. We were told to file a motion to reavaluate custody, where can I go to do this form?

I am not exactly clear on the status. Did she move and leave the child or take the child with her? IF she left the child, then you should file a motion so that eventually orders are in place to support her remaining there. If she took the child, then she is arguably in violation of the parenting plan/decree and a petition to that effect should be placed before the court.

As for a retainer, different lawyers have different policies. Depending on what the actual needs are, will affect what kind of retainer is provided. For example, if it is a relocation issue, I would probably take $2500 at first to see where the case is going. If more is necessary, I increase the retainer or get a trial retainer.
