both parents wanting sole custody-no marriage

i have paternity established in my case and my son has lived with me for 2 yrs and i live in south dakota, but still have arizona juristdiction, father pays child support, but has no contact with chiold and hasnt since march 10th 2003, i am waiting for a litigation hereing to be set, but when that comes do i have a 99% chance of keeping my son in SD and keeping sole custody? Please Help me?

Thank you for your inquiry.

I cannot tell you your chances of "keeping sole custody" without knowing more about your case. If the current order is for sole custody, then dad will have to show a change in circumstances that justifies changing the custody/visitation situation.

However, since you've been out of state so long, you might want to consider consulting with an atty in your state to determine whether the UCCJEA (Uniform Child Custody Jurisdiction Enforcement Act) would require the case to be moved to your state.
