Legal Question in Family Law in Arizona

Paternity

Ins the state of Az, if the father's name is on the birth certificate does that automatically establish paternity to the child or does it still need to be determined through a Paternity/DNA test. Also, if the father is required to pay child support does that give him automatic rights to visitation with the child or would he have to establish custody seperately from the child support itself.

Thank you for your assistance

Re: Paternity

Having the name on the birth certificate eliminates the need for a dna test.

However, the Father still does need to obtain a formal Order from the Court, and that Order will then allow father to begin pursuing custody and/or access.

Until he has an order of Paternity, he has no legal rights.

I can explain the procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Audrey to schedule a free 1/2 hour consultation. I look forward to talking with you.
