Legal Question in Family Law in Arizona
I pay child support and my son will turn 18 on 9-26-11. My court papers say the presumptive end date is 5-31-12 because that is when he should have been graduating. He transferred to a charter school the end of last school year because he was not doing well and not attending so the school was going to expel him. He lives with his father and he does not enforce the school issue. He is now doing the same thing at the charter school. My question is, "Do I continue to pay child support until 5-31-12 even though he will not be graduating when he is supposed to?"

If he is still enrolled/attending school, then child support would continue past his 18th birthday until he graduates (but no later than age 19). If he has "dropped out" after his 18th birthday, then your obligation would terminate at that time.
Most likely yes.
We can certainly help you consider and then pursue your options for addressing both the schooling issue and the support issue.
