Legal Question in Family Law in Arizona

Petition to Establish Child Support

I have been served with a petition to establish support and judgements for support. My daughter's mother and I are not married, nor do we live together. I have been paying her $300.00 a month and now I am finding out that she has been collecting state aid and not telling them about the support I give her. The petitioner on the order is the State of Arizona as The Department of Economic Security. I have some receipts for the money I have given, but will need to rely on eyewitness statements and text messages to support the fact that I have been paying her $300.00 a month. What should I do next. Do I need to file a response? Should I call the Department of Economic Security and report that I have been paying support? I have not received any aid from the state nor did I sign any papers for my daughter to receive aid. Also this order does not address visitation or shared custody. Should I file those papers now or wait until this is taken care of? Thank you for any help.

Re: Petition to Establish Child Support

The State's papers do NOT address visitation/parenting time and by not doing so, your child support obligation will be significantly higher. You should respond and also file a petition to establish custody and parenting time. If you need help give me a call. I am a family law attorney here in the Valley.
