Legal Question in Family Law in Arizona

Petition to Modify Parenting Time

My ex-spouse and I have 50/50 custody of our son, who is in Preschool. Ex-spouse is a workaholic who forgets our son on the days he's supposed to pick him up, leaves him at daycare for 10+ hours a day, whereby I am called by the school/centers to come and get him. My divorce decree has a Parenting Plan (that ex-spouse does not adhere to), which states that we must go to the Conciliation Courts first to mediate. Only problem is, we cannot go until one year has passed from the date the divorce decree was signed/recorded (which will be this October). It is detrimental that someone step in and get a handle on this (legally) or assist me in what I can do - my son is almost 4 and cannot handle being left at school by his Father, who forgets to pick him up. There has to be something we can do, besides waiting for Conciliation Court to ''allow'' us back in, this coming October. Please help?

Re: Petition to Modify Parenting Time

You could try to get in through the back door and file for a child support modification. It would not modify the parenting plan but would give you the additional child support funds you deserve. It will also make it easier when the year rolls around to modify the parenting plan. If you would like an attorney to help you through the process, and perhaps strong-arm him into a premature "agreed" modification of the parenting plan, give me a call.
