Legal Question in Family Law in Arizona

Pima county superior court wrote

"NOV - 9 2009

No. SP-*#@*!

ORDER RE:

CUSTODY AND VISITTATION" (real spelling by court)

"This matter having come regularly for hearing, Petitioner appearing in person and by her attorney, RO, and the respondent, appearing in person and by his attorney, JL,

THE COURT FINDS:" (child support orders, ect.)

"DATED this 9th day of November, 2009

LESLIE MILLER

JUDGE LESLIE MILLER" (and signatures from both my attorney and attorney for minor)

I was not present nor was I informed, at all, about any such matter.

Is this legal ?

- if not -

What can I do about this ?

Without seeing the entire document or knowing more about the case, it is hard to say what your legal rights are. However, it probably is legitimate. Likely you were not able to be located and they tried service by publication (in a newspaper in the area) and still didn't reach you. If you question the legality of the order you can always ask the court to reconsider. But if it's all accurate and in compliance with the law, there's not much you can do. Good luck.

You can seek to set aside the Order, BUT TIME IS OF THE ESSENCE.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gloria or my paralegal Jennifer to schedule your free 1/2 hour consultation
