Legal Question in Family Law in Arizona
I am planning to file for divorce and one question remains: at the present time, I'm covered under my husbands Tricare insurance through his military service, and want to know if I can petition the court to remain on Tricare after the divorce. Tricare is my secondary insurance as I'm currently covered under my own health insurance. I know that I'll lose base privileges when the divorce is final but wondered about Tricare.
1 Answer from Attorneys
Former spouses of active, retired or former military members may be eligible for TRICARE if they meet certain of many requirements, one of which is that you must have been married to the member for at least 20 years, and at least 20 of those years must have been creditable in determining the member's eligibility for retirement pay.
We can certainly help you consider and then pursue your divorce options.
