Legal Question in Family Law in Arizona

I am currently pregnant, and the father of my child and I are not together. The father has insisted that we have a paternity test done on our own before I file child support paperwork, even though the court will preform one. He also has requested that I not put his name on the birth certificate. I have been considering moving to Texas after the baby is born, and most likely before the child support paperwork is filed. Is there any way that the father could claim kidnapping if I were to move, even though his name won't be on the birth certificate?

There is no law which prevents you from leaving with the child. However, you should meet with an attorney before you make that decision, because there can be other disadvantages to doing so. You also should discuss a new Arizona statute in the works which give unwed Father's additional rights that they've never had before.

We can certainly help you consider and then pursue your options. This is obviously a very important matter, and you should not go in alone.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Alicia or my paralegal Jennifer to schedule your free 1/2 hour consultation.
