Legal Question in Family Law in Arizona

prepaying divorce settlement

A default hearing is set for April 13 and my wife needs the money I agreed to pay her now. What would be the affect of me paying her the settlement before divorce is finalized by judge? Would I have to pay again? Should I have her sign an agreement waiving any future payments ordered by court? We had a premarital which specified what her settlement would be.

Re: prepaying divorce settlement

I would certainly want you to, at a minimum, get a well-written "receipt" which indicates that the amounts being paid are being paid in accordance with the anticipated Decree, in accordance with the settlement reached, and in full satisfaction of both.

We can help you draft such a document if you like.

Please call me directly to discuss the specifics of your case. I look forward to talking with you.
