Property after a seperation

Is property acquired after the filing of a divorce still considered community property? I am buying a business and currently seperated. Does he have a right to half of the business. It was not purchased with any money from the marriage.

Thank you for your inquiry. Generally speaking, property acquired after a divorce petition is SERVED is considered "sole and separate," so long as no community funds were used for the acquisition.

Typically, any property acquired after the date of service shall remain your sole and separate property, so long as it cannot be "traced" to marital property.
