what would be some of the reasons why a judge would deny my petition for "emporary orders without notice"right now i have my kids for a few days for spring b. My kids are always nervous/scared of going to moms house.

The judge can only grant temporary orders without notice if there is some sort of "emergency" that cannot wait for the standard modification process. If you believe the children are unhappy or that their wellbeing is at risk in their mother's care, you can ask the court to modify the current orders, but the mother must be given notice and the opportunity to participate unless the judge believes that the children would be in danger of physical/emotional/psychological damage by giving the mother advance notice of the proceedings.
