Legal Question in Family Law in Arizona

I recently became engaged to a man that owes back child support. Can or will they garnish my wages to pay it back since he is unemployed? Also, is there a way to petition to have the amount adjusted, as he was in jail when his ex filed, he lost his good paying job, which income they went by, he was unemployed for quite sometime and was also homeless. We currently live in Az but his divorce was filed in the state of nevada

The Court cannot go after your income in collection his child support obligation. Also, child support is modifiable based upon a significant and continuing change in circumstances, but cannot be modified retroactively.

We can certainly help him consider and then pursue his options for addressing current and past child support issues. This is obviously a very important matter, and he should not go in alone.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
