Legal Question in Family Law in Arizona
Release of Stay
I got divorced towards the end of 2003, and both my divorce and child support were filed in Arizona. I filed a child support modification in August of 2004, and the judge issued a stay on the proceedings due to the fact that my ex-husband is stationed in Korea. The stay was dated until April 4, 2005. I talked to a person at the court house, and they told me that I could not have anything done with the case until he was back in the US. I spoke to a lawyer, who told me that I needed to file to release the stay, then refile the child support modification. I do not really have the money to hire a lawyer, but I need more specific information that what he gave me. If anybody can give me the form names and what I need to file I would greatly appreciate it.

Re: Release of Stay
I am not sure whether you can proceed against a soldier stationed overseas, but the best thing to do is call the JAG office of the military base closest to you and they should be able to help. My previous experience with the military is they are very involved in making sure dependents are taken care up. But since your case is in Arizona I can offer no more.
