Legal Question in Family Law in Arizona

Relinquishing parental rights

I moved from Missouri 2 months after my daughter was born. My ex still lives there. He was in jail at the time of her birth (and was there until her 2nd birthday). he has not given any support, and i now have sole custody. he wants to give up his rights so he doesnt have to pay childsupport. if he gives up his rights, does he still have to pay?

Re: Relinquishing parental rights

He does still have to pay. In Arizona, termination of parental rights does not terminate the parental responsibilities unless someone is going to assume them. The state of Arizona would rather pursue your child's "father" for unpaid support later in his life in the event that you need public assistance than have no one to go after. That being said, there is no requirement that you seek out the bio-dad for the support or attempt to enforce the child support order. If you terminate rights now and find someone willing to adopt, the future adoption will be far easier.

Call me if you need someone to help you with the process.
