Legal Question in Family Law in Arizona
I relocated to other state with our kids in July 2010. I have sole custody of our kids of 8yrs and 6yrs old , their mother has 1 week Christmas and 4 weeks summer parenting time. But she requests to take them this entire summer break out of the country to visit at her home town.
Not only I object to it( I really worry that she would not return with the kids), the kids don't want to go with her either. They rather go to visit her and their friends in AZ.
I am thinking if I could seek custody evaluator to interview my kids to help in the decision of the judge not to grant her the trip.
1 Answer from Attorneys
IF THERE ARE NO RESTRICTIONS IN YOUR ORDERS AS TO OUT OF COUNTRY TRAVEL, YOU NEED TO FILE QUICKLY TO PREVENT SUCH.
We can certainly help you consider and then pursue your options for modifying your Orders to prevent such. And yes, the children can be interviewed as part of that process.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
