Legal Question in Family Law in Arizona

After a response was filed to a divorce petition with no changes except a couple of personal items, name change and request for conciliation, a conciliation was scheduled. The respondent did not come and the conciliation was dismissed. What is the next step? Custody and Parenting still need to be figured out but all else is in agreement. Mediation? Default?

You cannot proceed via default if a Response was filed. You could request various things from the Court in order to address the outstanding custody and parenting time issues, including a Motion for Parenting Conference, Motion for ADR Settlement Conference, Motion for Mediation and/or a Motion for Resolution Management Conference.

If you would like an attorney to represent you in resolving the outstanding issues, our law firm can assist you and we typically require $3,000 up front to being working on this type of case. If that is feasible for you, please feel free to contact my Client Coordinator, Jessica Worley at 602-548-4600 to discuss your case in further detail.
