Legal Question in Family Law in Arizona

Retirement

Parties marry, divorce, re-marry eachother again, then divorce eachother again; the 1st decree of DOM awards wife her portion of husband's retirement; the 2nd decree is completely silent and makes no mention of retirement whatsoever; is the 1st decree still in effect or does wife need to submit something to the court referencing the issue of ex-husband's retirement?

Re: Retirement

The first Decree is, of course, still binding, just as if the 2nd marriage were to a different spouse. Also, if the second Decree is completely silent as to retirement benefits, you probably still can claim the additional portion which accrued during the second marriage.

We can absolutely help.

I can explain the issues and procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Alicia or my paralegal Jennifer to schedule a free 1/2 hour consultation.
