My wife and I have been separated for a little over a year now. I am in Mesa AZ; she has been residing in Country Club Hills, IL. We have no children. We bought a home together in August of 2005. For the most part, I have carried the brunt of the expenses of the house, from mortgage, to HOA, to utilities, to maintanence since the purchase of the house. In the mean time, my wife, who does receive disability and social security payment monthly has not support my effort in keeping the house, but is using her funds to support the household of the sister she lives with. While she does receive $1200 per month, she has recently started running up her credit cards to supplement her income. However, I have come to know that this newly incurred CC dept was used to bail her brother out of jail and to help with her sister's mortgage. A legal or permanent separation was suggested to me to protect me from being liable for any debts she incurred during our time apart. And somehow, I was given the notion that depending on the time she has been away will determine if she can qualify for spousal support or not (I don't believe that, but thought I would ask anyway). I need straight forward advice as to what I should do ASAP.
