I have been served with a petition to stop a child support assignment. In the box on the form it states: Explain why the order should be terminated and gives this as the first option (which is checked):
All past due child support has been pad and the person making payments is no longer obligated to pay child support becasue: 1. are 18 and not attending high school or a certified equivalency program.
My son is 17, (will be 18 on 6-27) and is attending Community College (has his GED). My question is: Is going to Community College considered a "certified equivalency program"?

If he has his GED, then child support terminates when he turns 18 years old. The only way child support continues beyond age 18 (but not later than age 19) is if the child is still attending high school or a high school equivalency program (e.g. if he was still pursuing his GED after reaching age 18).
Child support continues until the child's 18th birthday even if he is not attending high school.
