Legal Question in Family Law in Arizona

I want to severe my rights as a father to a child who is not biologically mine, I did not know the child was mine until after the child was born. What is the process I need to take? The mother is unwilling to do it herself.

Well............... you can sever by signing a CONSENT. She does not need to be part of it. BUT, YOU CANNOT TURN THAT INTO A COURT ORDER without her participating. Thus, you would have a document where you are waiving your rights, but not an actual order which severs your rights.

Also, will she agree to waive child support? If not, then simply severing your rights has ZERO effect on your obligation to pay child support. IF SHE WILL AGREE, we can draft all necessary documents.

We can certainly help you consider and then pursue your options. This is obviously a very important matter, and you should not go in alone.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Alicia or my paralegal Jennifer to schedule your free 1/2 hour consultation.
