Legal Question in Family Law in Arizona

I have sole custody of my child in Arizona. If I marry the biological father, will that negate or affect my sole custody in any way?

During your marriage, I would expect that neither of you have rights greater than the other as to custody. Then, in the unfortunate even of a divorce, custody and parenting time would have to be re-established.

You could consider a PreMarital Agreement, which could confirm the custody and parenting time in the even of a divorce. However, even those terms may be modifiable depending upon all circumstances.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Alicia or my paralegal Jennifer to schedule your free 1/2 hour consultation.
