Legal Question in Family Law in Arizona

I was given sole custody of my son but the judge gave back support from March 1, 2010 and then changed the insurance out of pocket costs to 34%/66% which was a new ruling. Does that mean the change in out of pocket costs go from the back child support date or the date of the new ruling? Please let me know since my ex is saying that I need to pay the past eight months difference in bills that have already been paid. It just doesn't make sense to make a new ruling be effective on the date that the back child support is effective instead of when the new ruling was made.

Depending on how the Judge worded the order, I expect arguments could be made both ways. It is certainly reasonable for you to resist your ex's position unless the wording said very explicitly that the allocation of unisured expenses was ALSO retroactive.

We can certainly help you consider and then pursue your options. We could review your Decree and end a letter to your ex arguing your position.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
