sole custody, wanting to move out of state

My husband has sole physical custody and we moved to AZ from NC to obtain that custody. Now we would like to move back to NC. My mother's husband is extremely ill and was given a few months to live. My mother is financially incapable of taking care of herself. She has asked us to take care of her and her husband for his remaining time...and thereafter. What do we have to do to make our move to take care of my mother legal? His children were taken from his ex-wife because she handed them to him because she had a drug problem and many other issues including having them live in a house with random men.

First of all, he may be able to move at least temporarily until a court orders otherwise, as long as 60 days notice is provided. If he moves for a new job, health, welfare, or safety for him or the child, he can move without notice, at least on a tempoary basis.

In terms of a permanent move, you would need to petition the court to allow that to happen. With your facts, your husband may succeed, although there is no guarantee.

I have worked on a lot of relocation cases. They are not easy but they are winnable.
