Can my son get custody of his sons if he and wife divorce if she has an open DEA arrest for one year?

Well it shouldn't make it more difficult for him to get that custody. But it won't necessarily be much of a benefit either. It's hard to say what a judge would do with that information. If she would be prohibited from having custody under those circumstances then of course he would be given sole custody at least until the arrest term is over and then the court would revisit custody.
Your son absolutley has the right to fight for custosy if he beleives the children are better off with him, all things considered. And, the circumstances surrounding her potential criminal activity will certainly be relevant.
