my son is divorced and the papers let him claim his 2 kids every odd year his wife has already filed her taxes and claimed the kids he has them 50% of the time and does not pay child support per the courts can she legaly claim them in his year

She should not have doen that. There are steps that can be taken to force her to amend, or to force her pay Father for the additional taxes that her actions cost him.
