Legal Question in Family Law in Arizona

my son is 6 years old and his father has visitation only in our state which is Arizona because he lives in California. My son told me at the next visitation his father was going to take him to California behind my back. Can I get a protective order? What should I do?

You certainly can and should seek either a modification to your current orders or a restraining order. However, please remember that a Judge will need PROOF. Since a 6 year old will not of course be permitted to "testify", and even a court ordered child interview may be insufficient due to the child's age, we may have proof issues.

We can certainly help you consider and then pursue your options for establishing the threat and then seeking appropriate rememdies.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
