Legal Question in Family Law in Arizona

I am on my son's birth certificate (he's now 5 months old) but my ex cheated and is forcing a paternity hearing to obtain a DNA test. I want to raise my son, at least jointly. Am I obligated to take the paternity test? It doesn't matter to me, I love my son either way. And if I'm not his biological father, do I have any rights, considering I was there through the pregnancy and had a big role in raising him while his mother struggled with mental health issues?

There are certain legal arguments you can raise to resist the paterniy testing. BUT, you must act quickly! Your biggest hurdle is that the child is only 5 months old. The theories I am aware of require a long term relationship and bond.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
