Legal Question in Family Law in Arizona

Split Custody & Delayed Support

5/22/91 - California Divorce - 2 children - each parent received 1 child and no support is ordered.

3/30/97 - Both boys became custody of father. Support paid to father in amount of $300 - no court order - agreement between parents

6/17/01 - Custody again split each to a parent - no support paid

8/11/01 - one child turns 18 goes into military and one child still in under age.

Can support be awarded to parent with the remaining child?

Re: Split Custody & Delayed Support

Under the scenario described, the parent with whom the minor child resides is entitled to seek support from the other parent. If you would like to discuss the calculations and the procedures, please feel free to contact me.

Re: Split Custody & Delayed Support

Jurisdiction will be where the child is currently located. If the child is located in Missouri, the custodial parent can seek child support by filing the appropriate documentation with the court. If you need assistance in the matter, feel free to give me a call. Best of luck with the situation.
