Legal Question in Family Law in Arizona

spousal support

If spouse is court ordered to pay and had his wages garnished then loses his job How do I go about getting the payments every month with out interruption? I think he is collecting unemployment.

Re: spousal support

Thank you for your inquiry.

If you have a copy of the Order of Assignment, you can send that to the Department of Economic Security (they are the ones that oversee his unemployment payments) and they should be able to garnish part of his checks (though probably not in the full amount you are ordered to receive).

The only way for the payments to continue without interruption is if he voluntarily makes the payments himself while he isn't working. He still owes the same amount (unless he asks the court to decrease or terminate the maintenance), so if he falls behind, you are entitled to enforce the order.

If you would like to discuss this matter in greater detail, please do not hesitate to contact me. I can be reached at (480) 792-9770 or [email protected]

Sincerely,

Monica H. Donaldson, Esq.
