Legal Question in Family Law in Arizona
my spouse is listed as the father on my baby's bith certificate. The biological dad wants me to go to court so he can sign over his rights so i cant come after him in the future for child support. I dont want to have to go through the process of changing everything to change it all back to the way it was originally. I have no intention of asking him for anything. Short of him filing for paternity do I legally have to do anything or can I just ignore him? if he does file for paternity can he then just sign his rights over?

Probably your best bet is to go ahead and let him sign over his rights if that is what he wants to do. This will make things easier in the long run. Then your spouse could adopt the child. This would make everything legal and on the up and up.

It would be wise to "pounce", and have him sign a Consent to Termination of Parental Rights. If you wanted, you can also sign a "Waive of Support" form to him. You do not necessarily have to do anything else after that. We have excellent forms for both.
