Legal Question in Family Law in Arizona
My ex and the spouse
I am currently waiting for a PRE DECREE MEDIATION, I am in a custody battle with an EX high school Girlfriend. The Ex and I have twin girls, and my wife supports my decision to have a loving relationship with them. The Ex on the other hand wants us to have no part. My question is can my spouse be there in the PRE DECREE MEDIATION by my side?

Neither party may have any other person in mediation. It is confidential and occurs between the parties and the mediator only. Make sure your rights are protected because without her being able to prove a fitness issue against you, joint custody is presumed. let me know if you would like to talk further. Re: My ex and the spouse
Your spouse cannot be present in the mediation. The goal of the mediation is for you and the mother to try to reach agreements between yourselves (with the mediator's assistance) regarding your children. If your case proceeds to trial (e.g. if you don't settle), your wife can appear as a witness on your behalf.
