Legal Question in Family Law in Arizona

Is there a statute of limitations on the terms outlined in a paternity/custody suit? My son is now 24, and is wanting to take his birth father to court to uphold an agreement made via the suit to pay a pre determined portion of his college expenses for 5 years. His birth father failed to honor the agreement once he graduated high school, and is failing to uphold the agreement now. Thank you in advance for your time and consideration.

I am not sure your son has "standing" to sue. You certainly do, and maybe there is a creative way your son could also be a party as the "beneficiary" to the contract.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gloria or my paralegal Jennifer to schedule your free 1/2 hour consultation
