Can a former step father that has joint custody with the biological mother legally adopt said child without his current wife obtaining any legal rights to said child ?

A non-parent cannot have joint legal custody with a parent and a stepparent cannot adopt a stepchild if he/she is no longer married to the biological parent of that child.
