Legal Question in Family Law in Arizona

After step -parent adoption can I collect owed child support?

I just wanted to find out that if my husband adopts my daughter can I still collect the back child support that her real father owes even after the adoption paperwork goes through the court system? I am also wondering if this would apply to unreimbursed medical expenses that he owes as well?

Once the adoption is finalized, your husband becomes a legal parent to your daughter, with all rights and responsibilities.

To do this, the daughter's biological father must relinquish his parental rights and obligations. You may (and should), however, seek full reimbursement for back child support and medical expenses which were owed prior to the adoption finalization and which remain unpaid.

An Order of Adoption terminates Dad's FUTURE obligation, but has no effect on his past obligations (support, medical, and the like). However, you would not want to wait too long to pursue the past obligations.

We can absolutely help.

I can explain the procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Alicia or my paralegal Jennifer to schedule a free 1/2 hour consultation.
