Legal Question in Family Law in Arizona

First Steps in Custody and Child Support

Separated, never married. Two girls, 2 and 7. I am the mom and have the kids 90% of the time. Tried to keep it out of court but our relationship is deteriorating. He pays for 1/2 of child care and has the kids on his insurance, but he has become inconsistent with it. He also has them for 1 day or less per week, and is starting to become inconsistent with that as well. I would like to increase the amount and consistency of financial support. I would also like to encourage him into more parenting time at best. At least get a schedule in writing that addresses holidays. He just doesn't seem to understand how his actions impact me (ie being late with payment, being late to pick up the kids with no notice, not sharing in sick day responsibilities) I would like advice on how to proceed. Do I need a lawyer? Does it have to go into the court system? Does me getting additional financial support affect tax time? Will tax time or legal papers affect his ability to have them on his insurance?

Thank you for your email.

The only way to have enforceable orders regarding parenting time and child support is to go through the court. You are not required to have an attorney; the court has a website with a self-service center that provides forms and instructions.

We offer a free initial consultation, during which time we can answer all of your questions and discuss our fees. Please contact the office to schedule a time to speak with one of our attorneys about the details of your case.
