Legal Question in Family Law in Arizona
what steps do i take to get full custody of my son?
I am 16 yrs. old and i was date raped by a 25 yr. old man. After becoming pregnant the man ran to mexico. There was a past of abuse in our relationship. He has threatened to come to arizona and take my son back to mexico with him. I do not know his real name or if he is an illegal immigrant. What steps do i take to make sure that my unborn son will be protected , and how do i go about getting child support?

Until this man took legal steps, he has absolutely NO rights to your child. Thus, if he presented himself and attempted to take the child, it would be kidnapping. If you are fearful of him, you can also file an Order of Protection, which makes even just approaching or contacting you a crime.
In order to receive child support, you must initiate a "Paternity" Action, which allows a Court to enter an award of child support. However, this also opens the door for him to seek custody/access.
I can explain the procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.
Please call me directly to discuss the specifics of your case, or contact my assistant Jennifer to schedule a free 1/2 hour consultation. I look forward to talking with you, and really would be very interested in assisting you.
