Generally, assets acquired during marriage are community property, meaning 1/2 is yours upon dissolution of the marriage. This is the legal, rebuttable presumption that may be overcome with sufficient evidence, such as both parties declaring that it is the other's separate property. The same is true for the debt incurred during the course of the marriage.
