Legal Question in Family Law in Arizona

Tax deduction

My ex has to be current on child support as of 12/31/00 to take our son as a deduction. He sends checks though a clearinghouse for payment. I have a payment history printout that was run by the state showing that he was not current as of 1/3/01. He is telling me that he considered current until 1/15/01 because he goes through the clearinghouse. Is he right? Can I take our son as a deduction or does he get to?

Re: Tax deduction

The Arizona Child Support Guidelines do indicate that he "shall be credited as having paid child support that has been deducted on or before December 31 pursuant to an order of assignment IF the amount has been received by the Court or Clearinghouse by January 15 of the following year".

Please call if you wish to discuss this further.
