Legal Question in Family Law in Arizona

I am thinking about a divorce. I have a daughter, 7 years old and my wife and I have guardianship of our 7 year old grandson. My wife has no income. She cannot afford to pay rent or utilities. One of her sons is still under investigation for felony child abuse in Eloy, Arizona, another is in prison in Yuma, and another is 18 and will not work, he only smokes marijuana. I want full custody of my daughter and perhaps even my grandson. What are my chances?

I would set up a consolation to discuss this matter as it involves many legal steps. And, if your goal is custody, of either children or both, I would retain competent counsel.

With the facts that you have stated about your wife and her previous children, it appears that your chances would be good as to you obtaining custody of your daughter.

As to your grandson, that would be a separate suit and if it is in the best interest of the child that he live with you and if you currently have substantial contact with the grandchild, the court could grant you custody of your grandchild, and at a minimum visitation, but this case would be much more complicated, and both of his parents will need to be individually served.
