I am thinking of leaving my wife, I have a four and three year old, what are my legal rights when it comes to taking them with me?

When you are married, both parents have equal rights to the children. Meaning, technically, you could take the children with you. However, you will want to be careful as you don't want to appear to the Court as if you are attempting to keep the children from your wife and their mother. There may be more going on in the situation that would warrant you taking the children with you, but we would need more details to give you advise according to your specific circumstances.
