Legal Question in Family Law in Arizona

Tribal Laws and White Man Laws

I was married in a Arizona Court. My husband is a tribal member of the Yavapai Apache Tribe in Arizona. We have since had a child together and seperated. He is filing for divorce through the tribal court, but we were married through a regular court. He is also seeking custody of our daughter through the tribe instead of the regular courts. I am currently living in Texas. After i left he filed papers stating that i was not to take the child out of state, but i was already gone. What are my rights. What can i do? I am a single mom desperate to keep her daughter. I went to Legal Aide, and they wont help me because my husband has never lived in Texas before and they dont know the tribal laws. If i go back to Arizona my husband will take the baby onto the reservation where i will never see her, because im white. Is that fair?

No. It isn't fair. Your have a very complex legal problem and need the assistance of a lawyer. Custody battles can be very expensive. You should continue to search for an attorney who can assist you.
