Legal Question in Family Law in Arizona

Visitation

My ex-wife moved about a year ago, about 180 miles from where I live. We have joint custody of our children, but she seems to be interfering with my visitation rights. She won't bring them or even meet half way so I can see them or spend time with them. I'm sure she is saying bad things about me and my new wife (she is also remarried) to convince the kids they shouldn't stay with us. What can I do to force the issue of visitation? It was spelled out very well in the divorce decree, but she says things have changed since they have moved away.

Thanks for your help,

Re: Visitation

Thank you for your inquiry.

You are entitled to bring an action to enforce the terms of your visitation order. If she refuses because she says things have changed, the burden is on her to file an action to change the order; otherwise, she is in violation.

Did she get your consent before she moved? If not, did she file a request with the court for permission to relocate? It might be too late to do anything about the move now, but you might be able to get the court to order her to participate in the travel.

If you would like to discuss this matter further, please feel free to contact me for a free 15 minute phone consultation. I can be reached at (480) 792-9770. I also offer a one-hour in-person consultation for $60.

Sincerely,

Monica H. Donaldson.
