Legal Question in Family Law in Arizona
Visitation-No call,no visit?
I have sole physical and legal custody of my 9 year old daughter. We live in Arizona and her mom in California. Her mom is to get visitation every third weekend of each month. The mom has a pattern of not calling or arranging for visitation for months at a time.If she doesn't call to confirm that she ''wants'' her visit, do I have to still take my daughter and initiate making arrangements?

Re: Visitation-No call,no visit?
I doubt it. I would want to know exactly how the Decree is worded, however. It also may be a good idea to simply contact her in writing, or have an attorney to do so, indicating that unless she initiates or provides details each month, you will presume that no trip is to take place. Then, if she ever complains, you can show the Courts your efforts to resolve the issue.
I can explain the issues better by phone or in person. There is too much to cover via e'mail (and I am not the greatest typist). We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.
Please call me directly to discuss the specifics of your case, or contact my assistant Cathy to schedule a free 1/2 hour consultation. I look forward to talking with you.
