Legal Question in Family Law in Arizona

my wife has a child from a previous marriage...her child resides with her biological father...They are trying to obtain child support from my wife who does not work. Do they have the right to take support from my income (sole family income) from me, the step parent?

Generally speaking, your income is not included for child support purposes because you do not have a legal obligation to support her child; however, the court does have the discretion to attribute income to your wife if she is unemployed. I recommend she speak with an attorney to discuss her options and the best course of action.
